Terms & Conditions

FrontApp, Inc. (“Front”) has updated these Community Terms (the “Terms”), effective as of July 30, 2024. For the prior version of these Terms, please click here. Front reserves the right to modify these Terms at any time, which shall become effective upon posting such updates on the Community webpage.  

Introduction

The Front Community (“Community”) is intended to provide Community Users (“Users”) with the opportunity to exchange helpful information about Front’s Services. By accessing or using the Community, the User acknowledges that they have read, understand, and agree to be bound by these Terms, Front’s Privacy Notice, Cookie Policy, and End User Conduct & Content Policy which are hereby incorporated into and made a part of these Terms.

Login Credentials

Users are responsible for all login credentials, including usernames and passwords, and Front shall not be liable for any damages or losses that may occur as a result of User’s failure to maintain the confidentiality of their login credentials. Users are not permitted to share their login credentials with others. Front reserves the right to refuse registration of or cancel usernames or passwords it deems inappropriate. Users are responsible for notifying Front at legal@front.com if they become aware of any unauthorized use of or access to their account.

Acceptable Use

In order to ensure the Community offers a positive experience for all visitors, these general guidelines have been established:

• Users must comply with the requirements set forth in Front's End User Conduct and Content Policy (the “Policy”). For the purpose of applying the Policy to these Terms, any reference to “Services” and “End User” in the Policy shall mean “Front Community” and “User,” respectively, as used herein.

• Users must not change the subject of a discussion to something not intended by the original poster.

• Penetration testing of any kind is strictly forbidden.

• Users may not use the Community for commercial activities such as the advertising, the sale of products or services, sending commercial messages (including spam), offering  interactive games, or advertising of other chat forums or websites.

• Users must refrain from sharing personal information (telephone numbers, email addresses, etc.) of themselves and others. Front respects and protects the privacy of those who use the Community, and the Front Privacy Notice provides details of Front’s approach to privacy and how Front collects, uses and protects personal information. However, information posted on the Community is not protected and can be easily accessed by third parties.

• A User must not own more than one (1) account on this Community. If Front detects duplicate accounts, Front may at its discretion delete any secondary accounts.

Remedial  Action

Front reserves the right to manage the postings on the Community to provide an orderly presentation of the information. Moreover, Front may edit or remove any posting it considers, in its sole discretion, to violate the Terms or be inappropriate for the Community for any reason. Violations may result in the suspension or termination of the User’s access to and participation in the Community. Should a User disagree with an action taken, the User should contact Front at legal@front.com. 

Termination 

A User’s access to the Community may be terminated by Front immediately and without notice if the User fails to comply with these Terms. Upon such termination, the User must immediately cease accessing or utilizing the Community and agree not to re-register or otherwise make use of the Community. The User understands that Front may exercise this right in its sole discretion.

Intellectual Property Rights

User grants to Front a worldwide, perpetual, irrevocable, non-exclusive, sublicensable, transferable, fully-paid up and royalty free license to use (i) any ideas, expression of ideas, or other materials submitted to the Community, including photo(s), video(s) and other forms of content which may include the User’s name, image and likeness, testimonials and other statements made by the User (collectively, "Materials"), and (ii) any and all intellectual property rights that cover or are in any way related to the Materials, whether in patent, copyright, trademark, trade secret, or any other proprietary right, in each case without restrictions of any kind and without any payment or other consideration of any kind, or permission or notification, to User or any third party (the “License”). 

The License shall include, without limitation, the right to reproduce, prepare derivative works, combine with other works, alter, translate, distribute copies, display, perform, and sublicense the Materials, and own all rights therein in the name of Front or its designees, throughout the universe in perpetuity in any and all media now or hereafter known. The License shall also include the right to, directly or indirectly (including through multiple layers of persons/entities), make, have made, use (including by Front customers), sell, offer for sale, import, distribute, and otherwise dispose of any product or service that includes any ideas, inventions, embodiments, or other concepts that are part of the Materials, and use any and all of User’s intellectual property rights related to such Materials. The License shall also permit Front and its designees to use the Materials (including portions thereof), modify any Materials, or incorporate other materials, either created by Front or any third party, with the Materials submitted by User. Any such derivative works shall be owned by Front and shall not be subject to User’s approval or payment by Front of any compensation to User.

User Warranty

The User warrants that the Materials submitted: (i) are original to the User, (ii) are true and accurate, (iii) do not violate and will not violate the rights of any third party or any local, state, national or foreign law, including any right of publicity, right of privacy or any other proprietary right, (iv) are owned by the User and are not subject to any claim of ownership by the User’s current employer, a former employer, or any third party, (v) do not contain the confidential information of any third party; and (vi) are submitted by the User on the User’s personal behalf, and not on behalf of an employer or any third party.  

The User waives any right to inspect or approve how the Materials are used and further waives any claim that the User may have with respect to such use. The User acknowledges that they will not receive any compensation other than any potential publicity received relating to the use of the Materials. User agrees to hold harmless Front and its employees, affiliates, consultants, contractors, subcontractors, agents or advisors (collectively, “Representatives”) from any and all liability for any violation of any personal rights (including right of privacy and right of publicity), intellectual property rights or any other rights which User may have arising out of or in connection with Front’s use of the Materials. 

Disclaimer

MOST OF THE CONTENT POSTED TO THE COMMUNITY IS PROVIDED BY THIRD PARTIES NOT AFFILIATED WITH FRONT. THIRD-PARTY CONTENT IS THE SOLE RESPONSIBILITY OF THE PERSON ORIGINATING THAT CONTENT. THE USER AGREES THAT FRONT DOES NOT CONTROL, AND IS NOT RESPONSIBLE IN ANY WAY FOR, THIS THIRD-PARTY CONTENT. ADDITIONALLY, THE USER AGREES THAT FRONT IS NOT LIABLE FOR, AND THE USER SHALL INDEMNIFY AND HOLD FRONT, AND ITS REPRESENTATIVES HARMLESS FROM ANY CLAIM, INCLUDING REASONABLE ATTORNEYS' FEES, MADE BY ANY THIRD PARTY RELATING TO OR ARISING OUT OF THE USER’S (I) CONTENT SUBMITTED, POSTED, TRANSMITTED, OR MADE AVAILABLE THROUGH THE COMMUNITY, (II) USE OF THE COMMUNITY, (III) VIOLATION OF THESE TERMS, OR (IV) VIOLATION OF ANY RIGHTS OF ANOTHER. 

THE COMMUNITY AND THE CONTENT ON THE COMMUNITY ARE PROVIDED "AS IS" AND CARRY NO WARRANTIES. FRONT DOES NOT WARRANT OR GUARANTEE THE ACCURACY, RELIABILITY, COMPLETENESS, USEFULNESS, NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS, OR QUALITY OF ANY CONTENT ON THE COMMUNITY, REGARDLESS OF WHO ORIGINATES THAT CONTENT. FRONT DOES NOT WARRANT THAT THE COMMUNITY IS SECURE, FREE FROM BUGS, VIRUSES, INTERRUPTION, ERRORS, OR OTHER LIMITATIONS. USERS UNDERSTAND AND AGREE THAT THEY BEAR ALL RISKS ASSOCIATED WITH USING OR RELYING ON THAT CONTENT. FRONT IS NOT LIABLE OR RESPONSIBLE IN ANY WAY FOR ANY CONTENT POSTED ON OR LINKED FROM THE COMMUNITY, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN CONTENT, OR FOR ANY LOSSES OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF OR RELIANCE ON ANY CONTENT. 

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FRONT AND ITS REPRESENTATIVES ARE NOT LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING DAMAGES RELATING TO LOSS OF BUSINESS, TELECOMMUNICATION FAILURES, LOSS, CORRUPTION, SECURITY OR THEFT OF DATA, LOSS OF PROFITS OR INVESTMENT, OR THE LIKE), WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, PRODUCT LIABILITY, OR OTHERWISE, EVEN IF FRONT OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF A REMEDY IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE THIS AGREEMENT BETWEEN FRONT AND THE USER.

IN NO EVENT WILL THE AGGREGATE LIABILITY OF FRONT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR ANY AMOUNT PAID BY USER TO FRONT DURING THE SIX (6) MONTHS PRIOR TO THE FIRST EVENT OR OCCURRENCE GIVING RISE TO SUCH LIABILITY. 

Violations of Intellectual Property Rights

Front reserves the right to remove any Material from the Community that infringes on the intellectual property rights of another person or entity and to terminate, at its sole discretion, Users who repeatedly post infringing Material. Individuals can report infringing Material to Front by emailing privacy@front.com and providing the following information regarding the infringement:

• Copyright or Trademark Owner’s name

• User’s name (if different from above)

• Address

• URL where the alleged infringing Material appears

• A description of the alleged infringing Material

• A description of the the copyrighted / trademarked material

Front may ask for additional information to assist with evaluating any claim. Individuals submitting a claim under this section acknowledge that any information provided may be shared with the affected parties upon request. 

Miscellaneous

Governing Law; Venue. These Terms and any disputes arising under them will be governed by the laws of the State of California without regard to its conflict of laws provisions, and Front and User consent to the personal jurisdiction and venue of the state or federal courts located in San Francisco, California.

Changes to the Community. Front reserves the right at any time to delete, modify, suspend, or discontinue, temporarily or permanently, the Community (or any part of the Community, including any postings) with or without notice. Users agree that Front will not be liable to Users or third parties for any modification, suspension, or discontinuance of the Community.

Relationship of the Parties. These Terms do not create a partnership, franchise, joint venture, agency, fiduciary, or employment relationship between the parties, and User does not have any authority of any kind to act on behalf of Front in any respect whatsoever.
